Obama gave a speech yesterday which attempted to lead the American people to believe that the Supreme Court of the United States (SCOTUS)doesn't have the right to overturn laws made by the legislative branch, calling it activism by people not elected.

Of course even Junior High school students know that our form of government provides a "checks and balances" process that indeed sets the very job of SCOTUS to provide a check and balance over Congress' right to make laws. SCOTUS ensures that laws enacted are actually Constitutional. Otherwise, Congress could enact laws that would actually overturn our form of government.

Today, 3 Justices at the U.S. Court of Appeals for the 5th Circuit ordered the Obama Department of Justice to answer if the Obama Administration believes that Courts have the right to strike federal law.

The three-judge appellate court appears to be asking the administration to admit that basic premise -- despite the president's remarks that implied the contrary. The panel ordered the Justice Department to submit a three-page, single-spaced letter by noon Thursday addressing whether the Executive Branch believes courts have such power, the lawyer said.

Appeals Court Judge Jerry Smith told the government lawyer (in court for another challenge to ObamaCare by doctors) that Obama's comments the other day about unelected judges makes it appear that Obama does not believe Courts have the right to strike unconstitutional laws.

My bet is that Obama will simply ignore the Court order. Today Obama said he meant that it would be unprecedented for the court to overturn laws passed by a duly elected Congress. That simply shows how little Obama actually knows about the American system of government and the very purpose of SCOTUS. Obama went on to say

Mr. Obama suggested he meant that it would be "unprecedented" in the modern era for the Court to rule the law exceeded Congress' power to regulate an economic issue like health care.

"The point I was making is that the Supreme Court is the final say on our Constitution and our laws, and all of us have to respect it, but it's precisely because of that extraordinary power that the Court has traditionally exercised significant restraint and deference to our duly elected legislature, our Congress. And so the burden is on those who would overturn a law like this," Mr. Obama said.

Is Obama not getting the point? Ordering every American to purchase a product while the US Government gets to define its contents is unconstitutional. Taking over the health care industry by the US Government is unconstitutional. Allowing Kathleen Sebelius to determine who lives and who dies, who gets what treatment and when is unconstitutional. And do remember, Sebelius was not elected either. Neither were Obama's czars who are given cart blanche over various areas of government. The EPA also was not elected but seems to have been given unprecedented power by Barack Hussein Obama.

Give me a break! The Department of Homeland Security is working to provide illegals "unlawful presence waivers"! Illegals merely have to prove they have an American relative Say what? How the heck does that 1.) Keep Americans safe and 2.) pass the Constitutional test? Since the USA has been allowing and making anchor babies (babies born to illegals) US citizens, this new program simply encourages all families of a pregnant illegal to come aboard and let US taxpayers support the lot of them!

This appears to be part of the Obama Administration's bigger plan to blow off Congress by using its executive powers to grant illegal immigrants backdoor amnesty. The plan has been in the works for years and in 2010 Texas's largest newspaper published an exposé about a then-secret DHS initiative that systematically cancelled pending deportations. The remarkable program stunned the legal profession and baffled immigration attorneys who said the government bounced their clients' deportation even when expulsion was virtually guaranteed.

Wonderful. It's like America isn't far enough into debt and government dependency without adding a few million more.

Guess that means Obama's illegal aunt can continue to live in public housing and surely his illegal uncle gets to stay too.

It's got to be fun to be able to gamble with other people's money. It certainly changes how much and on what a person is willing to place bet. In this case, Barack Hussein Obama once again placed a failed bet on solar energy with $2 billion of taxpayer money.

(Reuters) - Solar Trust of America LLC, which holds the development rights for the world's largest solar power project, on Monday filed for bankruptcy protection after its majority owner began insolvency proceedings in Germany.

Solar Trust of America is estimated to only have $10 million in assets while its debt ranges in the $50 to $100 million category. The company was offered a $2.1 billion loan guarantee last year by the Department of Energy Secretary, Steven Chu.

Fortunately for taxpayers it appears Solar Trust of America did NOT get the loan guarantee. Some news stories have Solar Trust turning the loan down after its approval; and some stories indicate that Solar Trust didn't meet the timeline required. Let's hope one of the other is true and that $2 billion of the taxpayers' money is not on the line for this failed solar company.
